TERMS & CONDITIONS HAPPY PET HEALTH PLAN
About the plan
De Dierenkliniek has designed the Happy Pet Health Plan (‘HPHP’) to provide preventive care for pets in exchange for an up-front periodic fee. Covered in the plan are the services and products as described in the folder and/or on www.de-dierenkliniek.nl. Each pet must be signed up separately.
Pet Owner
The Pet Owner is the person paying for the HPHP.
Additional pets
Each additional animal of the same Pet Owner will benefit a 5% discount on the cheapest plan(s), provided that the amount due for all pets is credited to the account of De Dierenkliniek at the same day.
Duration of the agreement
This agreement shall enter into force on the date of signature of the agreement for an initial duration of twelve (12) months. After this initial period, the agreement is tacitly renewed.
Termination of the agreement
If the Pet Owner acts in violation of these terms and conditions, De Dierenkliniek reserves the right to terminate this agreement, subject to the fact that all products and services for which payment has been made have been or will be issued. The Pet Owner will be informed by letter or email.
After the initial term, the Pet Owner has the right to monthly terminate this agreement with due observance of a notice period of one (1) month, subject to the fact that all products and services of the current contract have been paid. The agreement can only be terminated within the initial period in case the pet passes away. In that case, the outstanding amount for the services and products obtained must be paid immediately. If this is not the case and the Pet Owner nevertheless terminates the agreement within the initial period, De Dierenkliniek will calculate the discounts obtained up to that point.
In the case of the termination after the initial period of an agreement with annual payment, the compensation for the months no longer used will be refunded within eight (8) weeks after deduction of annual payment discount.
Periodical payment
Pet Owner can choose between monthly or annual payments in advance. In case of annual payments, Pet Owners receive a discount of 2% and the invoice must be transferred within two (2) weeks or paid directly by debit card. If Pet Owners opt for monthly payments, one authorizes De Dierenkliniek to debit the periodic fee around the 25th of the month. Registration costs must be paid in advance in cash or by debit card. The Pet Owner ensures collection of the periodical fee until the agreement has ended. This is an exclusive agreement between Pet Owner and De Dierenkliniek.
Price increases
De Dierenkliniek reserves the right to adjust the periodic subscription fee for the HPHP for inflation on the 1st of January each year. No further permission from the Pet Owner is required.
De Dierenkliniek may increase their pricelist (other than the subscription fee of HPHP) at any time. Treatments requiring ongoing drug supply, like for chronic conditions, will be subject to common index raises.
Outstanding payments
If the periodic payment is not made one (1) month after the payment date, De Dierenkliniek is authorized with immediate effect to suspend all services associated with this plan until all outstanding invoices have been paid.
Discounted treatments
If the Pet Owner terminates the HPHP within three (3) months after receiving treatments at a reduced rate, De Dierenkliniek reserves the right to charge the Pet Owner the difference between the reduced and the regular rate of received products and services. This does not apply to the unfortunate circumstance of the pet passing away.
Responsibility of the pet owner
It is the Pet Owner’s responsibility to:
1. Visit De Dierenkliniek for products and services as provided for in the plan;
2. Inform De Dierenkliniek of any injury, difficulty or other relevant matter affecting the pet’s health.
Contract
This contract is an exclusive agreement between the Pet Owner and De Dierenkliniek. It is not interchangeable and does not concern treatments or products issued by other veterinary practices. In the event of a sale of the practice, this contract can be transferred to the new owner after prior notification by letter or e-mail from De Dierenkliniek.
Discounts
Discounts offered as part of the HPHP only apply to pets registered as participants in the plan.
Change of Terms & Conditions
De Dierenkliniek reserves the right to amend these conditions. The most up-to-date terms and conditions are published on www.de-dierenkliniek.nl. If you do not agree with a change, you have the right to terminate this contract with retroactive effect from the moment that the conditions have been changed with a maximum of three (3) months.
Terms of Delivery
The general Terms and Conditions of the Koninklijke Nederlandse Maatschappij voor Diergeneeskunde apply to all our deliveries; version 2018, filed with the District Court Midden Nederland under number 22/2008.
